My Rail 7 is my 2nd Trek, I also have a Remedy. I love riding my Rail, and I think in general Trek offer well designed bikes and good bang for buck ( at least here in NZ they are good value for money ). That said, I think there are always minor issues with any bike, and Trek is no exception...
I wouldn't have thought a big hit would loosen the headset. Do you have a torque wrench? You're really just preloading the bearings with the top cap bolt, torque to 4nm. Only thing I can think of is maybe you didn't loosen the stem bolts when you did it? Loosen stem bolts, torque top cap bolt...

As @KeithR says, here in NZ there is no maximum assisted speed limit. What we have is a maximum power output limit of 300w. Note that the maximum wattage of the motor may be much higher than the maximum power output

@AME geometry chart lists the head tube on the large as 110mm (it's dark outside and I don't want to go measure mine). 3x 10mm spacers plus standard Bontrager stem is 40mm. Measured from the crown, you're going to need around 180mm. If the 38 is cheap enough but the steerer is the wrong length...
