It's not like it's doing those things Constantly but rather infrequently and some of them can be resolved by just restarting the system so I think I will only contact Shimano in the off season. Not point ruining the season now because of minor problems.

If you do an air chamber service its normal that oil is sitting there. If its too much it could be a faulty seal (which is unlikely for a new shock) or too much oil filled in while it was assembled. But like I said: better too much oil than too little.
Brose doesn't rattle as far as I know but they are really unreliable. I wouldn't buy until the new motor iterations have a few trouble free miles on them. The rattling of the shimano starts only on really rough stuff compared to the bosch but a new motor is coming from them. I don't know about...
