Would like peoples opinions on the damage to my new bike.

I bought a new 22 levo comp last week. it was a "shop soiled" bike and i knew about a few scuff marks and i was fine with it. Price difference from this to a new unmarked bike at the same place was £100.
There was a couple of scuffs to the bars, shock, along with a few others that has slipped my mind, most noticeable one though was the steerer tube. However on closer inspection once it was home the scratched paint on the steerer tube is actually worse than just flakey paint. its actually dented (see picture) Also i have noticed a 10mm tear in the seat that was missed and only noticed it when cleaning the bike (have a picture of the bike at the shop to prove it wasn't done in my hands).

To be honest im not that fussed, however its more annoying thats its actually dented and may potentially make it hard to remove the bearing, Im not sure. If i had known it was dented i would probably of just paid a little more and got a new unmarked one.
Now i haven't mentioned anything yet as not sure where i would stand with this but wanted to get some advice from you guys before proceeding further.

"Shop-soiled" usually means a few scratches or things which won't affect the actual use of the bike. That bashed tube is more than that. It might affect the proper operation of the bike and therefore your safety, as well as maintenance problems.
How did the damage occur? It must have had quite a bash; has that affected any other parts of the frame?
I would reject it as "not as described" and ask for a refund, then pay the extra £100 for the perfect bike, which you will not spend the next few years worrying about.
If they argue, I would mention the Sale Of Goods Act and threaten them with legal action.

I definitely wouldn't be happy with that, to me that is not just "shop soiled", it's a damaged bike, and the price difference of 100£ doesn't make up for it...I would take it back and say you'd rather pay more for a new bike

As @Nicho says, to get a dent like that there has taken quite a knock ! I've crashed a lot of bikes and not had anything like that.

It will be considerably harder to change bearings and with the shape there will probably destroy the bearing way faster plus you don't know what else is wrong that you haven't seen.

For the sake of £100 - take it back !!!! That's not shop soiled .. that's buying someones soiled underpants.

To me that looks like it could be shipping damage. Bikes are shipped in a box, and that section of the steering tube could be damaged if the box was dropped or crushed.

Assembly at the LBS may have been possible, then designated as “slightly damaged”, then sold for a reduced price.

IMO, I’d exchange it.

In fact, the damage may not of been noticeable until the assembly process. The LBS may have then put in a claim and got fully reimbursed for a new frame, but sold the bike as “slightly damaged”. It’s unlikely that anyone (consumer) would even notice.

How much is a new frame? $$$
Maybe I’m stating the obvious but that’s the way I see it.

I have seen ovalised headtube when used to do warranty for bike brand. That was on the top not bottom but reckon that’s from a crash into tree & forks damaged the headtube. Am sure shop got a frame replacement & shouldn’t really be selling the warrantied frame without declaring it. Would return to bike if you can £100 is no saving dodgy shop

A friend bought a new bike and it had a couple of light marks from shipping. He complained about the scratches and got 10% refund.

£100 is an absolute joke, take that back for a refund!

Thanks all. Have spoken to said bike shop and they said to bring it in for them to look at. Will ride there after work tomorrow to see what they have to say.

•Get a refund
•get one in red as no more blue in stock (not keen on red)
•or get the carbon pro for 3k more.
•or put up with it and keep it

Get the red one if it’s brand new with no damage. It’s only a colour.

Or, check to see if there are any offers online for the same bike and if so ask for your money back and go elsewhere. They don’t sound like a local bike shop worth supporting

As someone else has said when you come to sell it you'll have to give it away. Also as someone has said where else will sell it to you for similar or less. You aren't going to get service if you need to take it back anyway!

I have seen damages to bikes like that after decades of working and managing shops. That only happens when outside forces are involved. Ie., a car backed into it, ran over it or was on a roof rack and smacked into a garage door etc.

I would return it and get something different.

I personally feel there is no way that damage to the head tube could happen while normally riding the bike.
