Replacing the dreaded Across Blocklock (Scott Ransom eRide 920)

This headset is driving me nuts with all the creaking, I've replaced it last year (the lower part), now it seems I need to replace it again.
I've been reading the posts with the various solutions, especially with the Wolftooth spacer but I don't really like it.
If I replace the headset with one that will allow the fork to hit the frame:
- how bad can the frame (aluminum) be damaged by the fork in case of a crash?
- would a sturdier frame protection help?

I do stupid stuff all the time and I can't think of one good outcome to letting my fork crown hit my frame. At minimum you're probably looking at replacing your frame and fork CSU in the event of even a mild crash. Maybe sprinkle in handle bars, brake levers and rim for fun.
