Fox DPX2 Float problem

Hi, my DPX2 Float shock locks out after riding it for a time with the initial part of the stroke going solid. I can then slowly compress the shock a few times with the initial part of the stroke will then compress as normal. Any clues to maybe I'm setting it up wrong ?

There is also some noise on the Internet that there were some faulty DPX2's about with Fox repairing them, can anybody confirm this ?
